SAN LEANDRO | CITY COUNCIL | The substantial $500,000 annual hit San Leandro’s general fund would have suffered following Oakland’s decision in July to exclude Waste Management’s from its next zero waste contract appears to have been averted.
In an article, first reported Thursday by the East Bay Express, Oakland city officials are nearing a compromise solution to end the growing controversy that followed the City Council awarding Oakland-based California Waste Solutions (CWS) a 10-year, $1 billion bid over Waste Management, which, subsequently, filed a lawsuit against Oakland. If a new deal giving Waste Management the right to pick up Oakland’s garbage and allowing CWS to be the city’s sole recycler is approved, some in San Leandro city government will exhale a huge sigh of relief.
As reported last month, Oakland’s decision inadvertently cost San Leandro fees paid by Waste Management to the city at its Davis Street Transfer Station. A portion of the fees, totaling around $500,000 annual could have been lost, along with over $1 million in permit fees San Leandro was expecting from a $100 million expansion of the transfer station. Infamously, San Leandro Vice Mayor Benny Lee unknowingly advocated against his city interest when he told Oakland city council members to select CWS, instead of Waste Management. In retrospect, many at San Leandro City Hall were unaware or unprepared for the potential loss of revenue.
In addition, the San Leandro City Council was again left in the dark earlier this week about the potential for a compromise in Oakland. San Leandro Councilmember Jim Prola advocated during a council meeting Monday night to schedule a resolution calling for the Oakland City Council to re-open negotiations with Waste Management. Prola suggested using language contained in a petition posted on Change.org.
“I don’t think it’s a good idea to fight with electeds in Oakland,” countered Councilmember Pauline Cutter, who added, “although I think they were wrong.” However, City Manager Chris Zapata, who, himself erred in sending a letter advocating for the city to Oakalnd officials just hours before it deliberated July 30, said he was scheduled to meet with Waste Management officials the next day.
“If you want to keep your powder dry for another meeting, that would be an advisable course of action,” said Zapata and the resolution was moth-balled. By Thursday morning, a possible deal was announced potentially ending the trash talk in Oakland and neighboring San Leandro.
Thank God for the lawsuit by WM. It saved our city millions of dollars in fees and hundreds of jobs.
This was a big mistake by our Vice Mayor. He almost cost the city he was elected in millions of dollars in general fund revenue that we need for our police and fire services, not to mention schools, libraries, parks and roads. These millions from transfer and permit fees went directly into San Leandro coffers. How did our Vice Mayor hope to replace these millions, or does he propose to cut our already thin police and fire. Don't even pretend he didn't know how this would affect San Leandro as he said, because he was elected because of his budget and financial expertise. What a LIAR Benny Lee is!

It also looks like she has dozens of supporters on the different San Leandro Commissions. These are the people who know San Leandro Council members best and they choose Pauline Cutter for Mayor. That's good enough to get my vote.
I have listened to and watched Council meetings and Souza is definitely the least intelligent Council person. She has taken the lead on, and done very little in her two terms. Souza would be a disaster for San Leandro!

Souza doesn't take sh-t from Cassidy and he knows it. Cassidy is a control freak. He was the same way on school board. Cassidy's ego is so big that he seems to think he's the only one with ideas. Cassidy takes credit for everything, seems to forget he's part of a team. Always rude, always condescending.

I was shopping at West Gate shopping center when customers were asked to leave the area because of a strong foul smell. It was later reported by officials that the source of the smell was methyl mercaptan a flammable colorless gas being used at the Waste Management's facility 2615 Davis Street. The smell was reported nearly 2 miles from the WM site. Students at John Muir and Woodrow Wilson schools were moved to the back field near Cherry Grove Park. Say it again the dump does smell.

Air quality complaints at WM according to some might be “low,” but the dump does still smell at times. I have noticed this when shopping at Home Depot at the West Gate shopping center and at Costco.
I have asked people working at Home Depot and Costco what the foul smell is? They say it comes from the dump at the end of Davis St. The smell is rotten, foul and nauseating. I have had to hold my nose and cover my mouth when walking to the store or back to my car. I have never called to complain about the smell because honestly I don't know who to call. Don't tell me the dump doesn't smell.

The one person trying to defend Benny Lee and Diana Souza's actions, and there is only one, seems to forget they were elected to represent San Leandro not Oakland.

Steve Tavares you need to do a follow up on how WM bullying minority family business. WM knows pending lawsuit that any banks wouldn't lend money to any business, including CWS. After WM refused CWS to use SL transfer station, CWS went to Richmond trash Co. they agreed to partner until WM threatened Richmond too.
Didn't want to believe in 2014 San Leandro still has quite of few vivid racists, especially this one person, his name is Tony Santos, he used the Chinese community in 2008 we donated so such money to his campaign, we walked for him and we even took him to China with us. Today we wake up and see the real Tony Santos, tell us why CWS money is not good enough for San Leandro!

Both Cassidy and Souza try to bully people, Cutter tries to find compromise like a leader should. Bullies always seem to have courage but that just leads to division. To be a leader you also have to have brains and a good heart. Souza is brainless and heartless, will say anything to get elected, but she has done nothing meaningful in her eight years on the city council. Here's one of Marga and Mike Katz-Lacabe's disturbing opinions. For example, when the police conducted a sting on men that were having sex in the bathrooms at Marina park. Marga spoke during public comments at a City Council meeting stating that gay men needed places to have sex since there were no more “Tea rooms” available to them. Mike was there with her videotaping her every word. Disturbing! Our children need advocates that would see something wrong with adults having sex in a park bathroom that children use. It is about values and safety for our children and our City. Gay or straight- rent a hotel room.

Also let's get the record straight, Diana Souza's employer is one the SL truck companies has long good business relationship with CWS. Nothing wrong with Duong Family supports Diana for Mayor, WE THANK CWS spending money in SL. CWS would have ordered at least between $40 million to $60 million worth of trucks from us. Do the math, approx.10% sales taxes between $40M to $60M plus $500k/yr by using WM transfer station. It could have been Win-Win for us. Waste Management bullying its way to Fight with Greed and want it ALL . We, SL, must watch Waste Management like a HAWK!

Finally San Leandro is back to being only slightly worse off that they were when California Waste originally won the contract.
How can I say that? What about the $500 million? Once California Waste won the contract, one of the first things they did was call Waste Management and ask to negotiate a deal to continue bringing Oakland's garbage to the Davis Street Transfer Station. Waste Management refused. That is the point at which San Leandro became in jeapardy of losing the $500 k, when Waste Management showed they didn't give a damn about San Leandro, didn't give a dame about keeping a multi-million dollar revenue stream, they just wanted to fight California Waste.
Noone expected them to be so selfish. One Councilmember had been briefed on the Oakland Garbage situation ahead of time, Pauline. She is our rep on stopwaste.org, who had discussed the matter on their agenda. To Pauline, the Oakland situation wasn't important enough to report back to the council. Why? Because noone expected Waste Management to be such babies that they'd turn down good money just so they could fight.
City staff knew California Waste was real, the EBMUD Board had passed a resolution unanimously supporting California Waste for the contract. Yet city staff never brought it to the councils attention, never said “$500k a year may be at risk”. Why? City staff didn't expect Waste Management to stab the city in the back the way they did.
We were all set to make money as a city. California Waste buys their trucks from two different San Leandro firms. California Waste gets their trucks serviced in San Leandro. We were about to get sales tax on another 120 trucks, and have no change in tipping fees. That would have been a win for San Leandro. Until Waste Management decided react in anger.

Waste Management are the villians, yet they're getting away with it.
Everyone needs to understand that, and write good faith language into future Waste Management contracts, or they'll stab us in the back again the next time they want to try and crush a competitor.

Once California Waste won the contract, one of the first things they did was call Waste Management and ask to negotiate a deal to continue bringing Oakland's garbage to the Davis Street Transfer Station. Waste Management refused. That is the point at which San Leandro became in jeapardy of losing the $500 k, when Waste Management showed they didn't give a damn about San Leandro, didn't give a dame about keeping a multi-million dollar revenue stream, they just wanted to fight California Waste.
Noone expected them to be so selfish. One Councilmember had been briefed on the Oakland Garbage situation ahead of time, Pauline. She is our rep on stopwaste.org, who had discussed the matter on their agenda. To Pauline, the Oakland situation wasn't important enough to report back to the council. Why? Because noone expected Waste Management to be such babies that they'd turn down good money just so they could fight.
City staff knew California Waste was real, the EBMUD Board had passed a resolution unanimously supporting California Waste for the contract. Yet city staff never brought it to the councils attention, never said “$500k a year may be at risk”. Why? City staff didn't expect Waste Management to stab the city in the back the way they did.
We were all set to make money as a city. California Waste buys their trucks from two different San Leandro firms. California Waste gets their trucks serviced in San Leandro. We were about to get sales tax on another 120 trucks, and have no change in tipping fees. That would have been a win for San Leandro. Until Waste Management decided react in anger.

Waste Management are the villians, yet they're getting away with it.
Everyone needs to understand that, and write good faith language into future Waste Management contracts, or they'll stab us in the back again the next time they want to try and crush a competitor.

The last two posters really don't know what they are talking about. Maybe they need to do a little research and talk to people near the WM plant. I have friends that live near WM. They tell me that the air quality complaints are very rare since WM put in a new building that handles the wet waste.

Oakland's city officials did not really come to a compromise so much as they chickened out and/or came to a strategic decision.
More specifically since so much money was at stake, Waste Management was prepared to follow through on making a huge public stink in charging that the hearings that “determined” which company was the best qualified had been nothing more than scripted, choreographed, and prearranged charades, and that the decision on which company to award the contract to had already been made illegally and in advance before the hearings ever took place.
While lit is true that is the way a large percentage of decisions are made by government agencies, for instance look at the record of the totally corrupt CPUC,*** however it would have been far too damaging to the city of Oakland in its future decisions and announcements if WM had had had more opportunity to continue widely broadcasting statements that would have caused much more of the general public to realize that a high percentage of our local government officials are nothing more than a bunch of pathological liars and sleazy crooks,
So as a resident of Alameda County, I am very “proud” of Oakland's city officials in their “taking one for the team” so as to ensure that not just people all over the Bay area, but also to some degree all over the entire country, did not get more enlightened as to how extremely sleazy and totally corrupt so many of our public officials and government agencies are.
However the worst thing about Oakland's city officials chickening out on having a courtroom trial related to the allegations WM made of an illegal backroom fix is that we did not get to see and be entertained by the circus of: one, the sleazy professional pathological liars with law licenses Oakland city government would have undoubtedly hired to “prove” that there was no illegal backroom fix; and two, the long parade of high ranking city officials and their staff members who would have circled the wagons and engaged in nonstop lies, and undoubtedly also pretended to be outraged that anyone had dared to question their integrity.
(In fact if I had been on the jury, whenever one of the lawyers got into high gear with their lies, garbage, and nonsense I would have passed a note to the judge asking if we could have the lawyer tested for drugs.)
***NOTE: While in the last few days the outrageous actions of the totally corrupt PUC have been finally been getting considerable publicity, however the PUC's culture of sleaze and illegal backroom fixes goes back decades. For example, and going back many years, the PUC has often been caught printing transcripts of its hearings BEFORE the hearings ever took place, since the hearings and its decisions are normally scripted and prearranged before the hearings ever do take place.
