CONGRESS//15TH DISTRICT/ANALYSIS | What happened last week to Rep. Eric Swalwell is better explained through cinema. Taken from the viewpoint of Swalwell’s large moderate, more well-to-do base in the Tri Valley, Swalwell’s unfortunate utterance of the word and imagery of a “wet dream” last Friday was the moment the young Jedi became his father. Pete Stark, the man who presided over the East Bay for four decades before being beaten last year by Swalwell, might have whispered from his barcalounger, “Eric, I am your father.”
Noooooo!
So, in one brief moment, the rookie congressman reneged on his biggest, most heartfelt, campaign promise from a year ago. After vowing never to embarrass the district with name-calling and truly outlandish behavior, Swalwell became Stark. (Watch the video below.)
The reaction to the phrase was so critical that even the local mainstream media, which has cheered Swalwell unmercifully after the past year, couldn’t look away. Josh Richman of the San Jose Mercury News reached out to Stark, whose comments sounded like last year’s campaign never ended. “I hope I’d have the good taste in all my outbursts not to say something like that, but I guess it gives you the measure of the man,” Stark told the newspaper.
Even the San Francisco Chronicle’s Carla Marinucci, who continues to confound many by her rah-rahing for Swalwell, noted the wet dream quote “raised eyebrows.” However, she remained insufferable by also noting a wet dream is a “natural bodily function.”
The Huffington Post suggested Swalwell’s speech may have violated the House rules for decorum, which prohibits members from disparaging each other or using vulgarity within the House of Representatives. Ironically, Republicans used the same rule to sanction Stark for saying President George W. Bush found certain eroticism by sending young men to get their heads “blown off” in Iraq. Swalwell’s behavior while in the people’s house has faced criticism in the past. ABC News noted this summer that Swalwell’s recording of a vote, later uploaded to Vine, violated House rules for the use of electronic devices. In both instances, Swalwell appeared unrepentant.
Tea Party adherents who voted for Swalwell last year will tell you he lied to voters the first time he appeared with Sean Hannity on Fox News last January and strongly-backed gun control. But, whether Swalwell ever communicated a pro-gun stance may have been part of their collective imagination and exploited by his brand of moderate politics that struggles to believe in everything and nothing at all. However, making national news for saying weird and nasty things is, by far, the number one reason conservatives in the district hated Stark and why even some liberals secretly wished he would go away.
After last week, Swalwell became exactly what he repeatedly told thousands, from Livermore to Hayward, he would never become—an embarrassment to his district.

I actually signed up for Obamacare and it was cheaper for me with a better policy. Even though I agree with this particular vote, I have seen Ellen at more events I go to and will be voting for her next year. I think she has accomplished more for the middle class and poor and I trust her to do more for us than Eric.

According to this Oct 16 article a large part of Swalwell's contributions came from the medical and pharmaceutical vested interest groups. These are the same groups that have been sticking it to the middle class and poor for years. My family and I will be voting for Ellen Corbett next year.

Eric is not running against Stark this time with his irascible temperament and personality. Ellen Corbett is a much more formidable foe and an extremely likable and capable politician. She is very likely to win as she has helped many people in this area over the years. I know our family will be supporting her.

I am reading about the naming of the bridge here and that is transit. If she votes to ban strikes so that seniors like me who are crippled can get to the doctor then I think I would vote for her. My wife and I ride BART and agree with the excellent narrative written about the present situation. The only way to settle this so that the public is not held hostage is to exempt the unions once and for all from never being able to strike again, just like MUNI and other mass transit systems.

campaign promise and this doesn't surprise most of the citizen

The Bay Area is facing a needless economic crisis. The “cooling-off period” in the dispute between BART management and labor expires for good Oct. 11, and all signs point to a lengthy BART strike.
A prolonged strike would have a devastating impact on families and the economy. Students and teachers may not be able to attend classes. Worse, the traffic nightmares that will probably result from a strike could impair the ability of police and firefighters to keep us safe.
But the looming BART strike is a catastrophe that need not happen. Senate and Assembly Republicans have put forward a balanced solution to keep the trains running on time while allowing contract negotiations to continue. Senate Bill 423 would require BART unions to honor the no-strike clause in their existing contracts. With support from the governor and a modest number of Democrats, a legislative solution could be achieved to prevent the almost 400,000 daily BART passengers from being stranded.
The Amalgamated Transit Union contract ensures uninterrupted transit service to the public by specifically prohibiting any employee or union to “engage in, cause or encourage any strike, slowdown, picketing, concerted refusal to work, or other interruption of the District's operations” caused by a labor dispute. Contracts for the other BART unions contain similar language.
To enforce this provision, Gov. Jerry Brown could call an emergency session of the Legislature and end the threat of a strike in a matter of days. In fact, we sent a letter – co-signed by Republican legislators throughout California – to the governor this week urging him to take action on our proposal. Unfortunately, he has not acted on our request, meaning that an easy solution is collecting dust in Sacramento.
Our proposal is not a new one. In fact, it's based on existing state law. Labor contracts between public employee unions and state government remain in effect even after the contracts expire. That way, normal operations continue until a new contract is hammered out. However, because BART is a local (not a state) agency, its unions are exempt from this law. This loophole exists in only one other major public transit system in the country. But our plan will close that loophole and spare the Bay Area from pending gridlock.
California is still barely recovering from the recession. The pending BART strike will cost the Bay Area more than $70 million per day. A recent Bay Area Council survey found that 70 percent of residents oppose a strike, and 92 percent believe a strike will have significant economic impact.
To be clear, we are not advocating for either side in this labor dispute. We urge all parties to come together and quickly find a resolution that makes sense for workers, management and taxpayers alike.

Common sense dictates that if other provisions of the unions' contracts, such as salaries and benefits, are being fulfilled, then the no-strike clause previously agreed to at the bargaining table should also be honored while negotiations continue. Absent that, our solution gives the governor and the Legislature the power to stop this strike before it starts. The time to act is now.

SB 205 Builds Upon Previous Patient-Centered Legislation by Senator Corbett
SACRAMENTO – Earlier today, the California State Senate approved legislation authored by Senate Majority Leader Ellen M. Corbett (D-East Bay) that requires pharmacists to print specific items on a prescription label in at least 12 point font.
The Board of Pharmacy (Board) was required to standardize the prescription drug label to make it more patient-centered following the Governor’s signature of SB 472 in 2007 by Senator Corbett. As part of that process, a 2009 Board-sponsored survey found that 60% of participants that responded believed that larger or bolder print would make prescription labels easier to read.
“SB 205 is urgently needed legislation since it will help keep patients safe and may potentially save lives by requiring larger font on prescription labels. This patient-centered bill requires that the most important items on labels appear in 12 point font: patient’s name, drug’s name and strength, directions for use and the condition for which the drug was prescribed,” Senator Corbett said. “We know that pharmacies are already able to provide this service since consumers may now request that their labels appear in 12-point font. SB 205 would simply require larger font, instead of making the easier-to-read size available only upon request. I remain hopeful that Governor Jerry Brown will appreciate the critical importance of helping Californians with vision challenges read the important information that appears on their prescription labels.”
California’s population over 60 years of age will increase by over 110 percent from 1990 to 2020, according to the California Department of Aging.
SB 205 is supported by the California Alliance for Retired Americans, California Pan-Ethnic Health Network, California State Retirees / Chapter 1, California Commission on Aging, Paramedics Plus, Vision y Compromiso and Pharmacists Planning Services, Inc.

I am committed to protecting our seniors and preserving the programs that have kept so many healthy and out of poverty. I support preserving and strengthening Medicare, and I believe that turning Medicare into a voucher system would hurt seniors and raise barriers to care. In Congress, I will work to preserve and protect Social Security, for example by raising the cap on earnings subject to the payroll tax, and strengthen Medicare to protect patients and support the physicians who care for them.
I strongly oppose using the Chained Consumer Price Index (CPI) to calculate cost-of-living adjustments (COLA) for Social Security Benefits. While the budgetary challenges we face are serious, we should not be balancing the budget on the backs of seniors.
What I am Doing for You
I signed on to House Resolution 34, which expresses the sense of Congress that Chained CPI should not be used to calculate cost-of-living-adjustments for Social Security benefits.
I sent a letter asking the Centers for Medicare and Medicaid Services to assume the Sustainable Growth Rate will be fixed when it determines physician payment rates for Medicare Advantage.
I voted against H. Con. Res. 25, the budget proposed by Budget Committee Chairman Paul Ryan. This budget would end Medicare as we know it, repeal the benefits of the Affordable Care Act – including preventive services for seniors – impose drastic spending cuts, and give massive tax reductions for corporations and upper-income persons.
I cosponsored H.R. 1029, No Loopholes in Social Security Taxes Act. This bill would increase the amount of income subject to the Social Security tax from $113,700 to $250,000.

My name is Johnson Fields and I have known the Swalwell family for more than 30 years. It seems to me that the only reason Ms. Corbett is contemplating a run for congress is because she has nowhere else to go due to term limits. Obviously it is her right, or indeed anyone else's, to run for congress. However, all that I have read here is innuendo, distortions, and in some cases, outright lies. Of course I am biased for Eric, and see him doing the best job he can. I am not aware of any 'mistakes' he has made. I simply believe this to be dirty sour grapes being lobbed against him and for no reason other than he won his election against Mr. Stark. This name-calling and threats of 'my candidate is better than yours,' etc. only seeks to turn off voters or potential voters. Whoever is behind these attacks does no favors for their professed candidate.

I agree that Ellen can and should win, but needs to start a strong campaign very soon. She has very strong support in most of the District where she is Senator right now. I hope she's making appearances in the other part of the Congressional District and will start having fundraisers there over the holidays. I know she had one in Dublin already. She is so strong a challenger that Swalwell staffers are scared of her and that's why they spend their time blogging like 4:54.

My family and I live in the Valley and have followed Swallwell closely since his Dublin City Council days. He definitely sold out the Valley to developers and many of us have asthma due to all the development out here. We will vote for Ellen because of her strong environmental record. My child has asthma so bad, he needs an inhaler.

In general, I agree that this is not a big deal. Politicians should be encouraged to speak off the cuff and say what's on their mind even if it offends some people–otherwise, it ends up being a cut-and-paste exercise where they spout political platitudes that say nothing at all (This is what Swalwell normally does anyway).
BUT this is a textbook example of Swalwell just being sort of a juvenile frat boy who is unfit to serve in Congress. It's not as though this was an off-the-cuff remark or something that was said in the heat of the moment. This was scripted and planned. And when someone makes an off-color comment in the heat of passion (as was Stark's style), I have no inclination to judge them, but when someone deliberately plans to say something that is juvenile and silly and does not enhance the conversation at all, then it becomes clear to me that they're just trying to act like a frat boy and draw attention to themselves.
