Reynoso shut out of meeting as Hayward school board plots next move for official holding two elected offices

Dr. Luis Reynoso, the newly sworn-in member of both the Hayward school board and Chabot-Las Positas Community College District board said he intends to serve both elected offices. Despite his clarity on this issue, Hayward school boardmembers on Thursday formally asked Reynoso to choose one seat before determining its next course of action.

Reynoso won re-election to the Hayward school board for a fourth term last month, while also winning the open seat Area 1 seat on the Chabot-Las Positas board. Reynoso took the oath of office for both elected offices earlier this week.

“The will of the people want me here,” Reynoso sad. “The board cannot change the vote. The superintendent cannot choose his boss and the board cannot choose their board members.”

Reynoso is also a Chabot-Las Positas Community College District board trustee.

After Reynoso was sworn-in to the Hayward school board last Monday night, a special closed session meeting was scheduled for this Thursday. Some community members questioned whether Reynoso’s bid for dual offices was warranted as a behind closed doors discussion. Thursday’s agenda listed only the government code for potential exposure to litigation.

Reynoso, though, was not allowed to join the special closed session meeting. When he attempted to address the matter during a brief public comment session prior to the closed session, he was repeatedly cut off by new Board President April Oquenda. She eventually called for Reynoso’s mic to be muted.

Reynoso then protested by holding up a handwritten sign that read, “They will not let me speak.” When the school board returned from closed session, Reynold held up another sign that read, “They never let me in closed session.”

Reynoso was asked to recused himself, he said, but he declined. Instead, the board shut him put of the meeting by not distributing the link for the Zoom conference call session.

“Whatever they talked about, they should have allowed me to listen and defend myself,” Reynoso said. “This looks like, to me, that they’re in there plotting something.”

The decision to block Reynoso from the closed session was for his own good, Oquenda said. “In order to protect Dr. Reynoso from breaking the law, he needed to be recused since the law prohibits him from influencing and participating in the any way in the board’s deliberations on this topic,” she said following the closed session meeting.

In addition, the school board is offering Reynoso a choice, Oquenda added. Either the Hayward school board or the Chabot-Las Positas Community College District board, but not both. The school board will then make its next move based on Reynoso’s decision.

The school board again asserted Reynoso’s service on both boards is prohibited by government and education codes because of the potential conflict of interest and dual loyalties, Oquenda said.

But the school board’s legal opinion is only an interpretation of the law. A possible next move by the school board could be to petition the state attorney general’s office for an opinion.

Reynoso’s bid to keep both elected seats inflamed some Latino community members who accused the school board of racism. Reynoso is the lone Latino school board member in a city whose population is dominated by the racial demographic. Others slammed the school board for attempting to overturn the will of Hayward voters.

“What you guys are doing is unfair. It is complete racism on your end and it is utterly white privilege,” said Maria Del Carmen Espinoza, a candidate in last month’s school board election. “We voted for Dr. Reynoso and we need you to respect our wishes because that is what voting is al about.” Another speaker who also voiced strong support for Reynoso, Eufemia Del Carmen Meynard, was also a candidate in the same race.

Oquenda noted Reynoso is the current school board’s only Latino trustee in her comments, but added, “This is not a personal issue and we have no desire to go against the will of the voters,” she said. “This is not something any of us wanted to happen.”

Are you so blind to believe Reynoso is our childrens’ Jesus? I thought you are were smarter than that and would see how he panders to his audiences.

  3. Lets circle around to the first points: this is a very PRO reynoso tabloid as Tavares and Reynoso are very friendly. Catch their energy from a recording years back. Super intimate vibe. Tavares uses Reynoso and vice versa. I am sure many laws and acts have been violated in this friendship.

    However, why are you not being truthful, Tavares? It would have been a COI to have reynoso sit in on closed. you know this. Why not report it? Why don’t you tell the public all the information Reynoso feeds you and his short sighted followers? Have you even heard his insane utterances? Come on now.

  4. Both April and Matt Wayne should stop with their personal Vendetta! This is all such pettiness. They need to put their hurt feelings aside, stop wasting the tax payers money on this meaningless plan of vengeance, and start using the tax payers money on what is most important.. our CHILDREN! Our STUDENTS! Stop wasting precious money April and Matt!

  5. It’s time for the parents and community of Hayward to protest and picket the Hayward Teacher Union and HUSD. According to CA school dashboard. HUSD has some of the lowest test scores in California. They continue to violate our children’s civil rights to an education. Maybe its time for the state of CA to take over.


  6. If you believe the HUSD board “puts children first” you are incredibly naive and lacking direct experience. It is a catch phrase used to subdue parents and voices of concern, My opinion is not to be misconstrued as a pro/con Reynoso statement, but as an alarm bell for others to understand, H.U.S.D is not pro student but pro Faraj. Should you want to address the most dysfunctional husd employee, despicable behaviors toward students and parents alike by her members then there is no need to waste time with the board or Wayne. Rub her right, get on a knee before her and stroke a very childish, sensitive ego and then maybe you will have been heard (is all). The controversy around Reynoso is because he still has yet to take a knee. I can only encourage him to still stand tall.

  10. Is this seriously a credible newspaper? Feels more like a “all things pro Reynoso” tabloid. Long on opinions; short on facts. I actually encourage Mr. Reynoso to come clean and tell the public what he knows to be true. He can’t serve on both Boards at the same time, per the law. The HUSD Board has asked him the make a choice. Seems reasonable and I don’t think they were obligated to do so. In fact, given the verbal attacks and character assassination by Reynoso’s supporters led by the del Carmen sisters ( who both ran unsuccessful campaigns for one of the three open seats.) Perhaps Maria would have won if Reynoso hadn’t run for a fourth term. Isn’t 12 years enough? That’s one year short of a child’s ENTIRE public school career!

    Why doesn’t he open the door for another Latino to win? Does he consider himself the only one qualified to be a “Latino” voice on the Board? I think not. There are other highly qualified Latino community members. Why isn’t Reynoso opening doors for others to follow behind him? Are we to consider that seat his forever?

As you know Oquenda serves Firaj hand and foot. Sad but true. And with the tax payers money. I wonder they remember that they are here to serve the children and not their own needs?

This is ridiculous, Oquenda needs to act like a adult, accept what has happened and honor our constitutional rights, we the people have VOTED for Dr. Reynoso. I bet if it were Carlson who would have won both elections, he would have been greeted with open arms. However, it didn’t work out for Oquenda, Wayne, and Rowden. Sorry, but not sorry.


  15. I’m not a fan of Reynoso, but the voters spoke and should remain on both boards. HUSD has always been run by the “White Power Privilege”. Faraj, Rawdon, Oquenda, and Wayne continue the tradition. They don’t care about the Black and Brown children education in Hayward. They just want to get paid. Oquenda even wrote an opinion piece talking shit about the black and brown charter schools in Oakland. The last thing the new White Power Privilege group want, is a brown guy exposing their corrupt ways.

  18. The law is the law. The statute says Dr. Reynoso can “run” for both offices; however not “serve” on both Boards. When he was elected to both Boards he either knew he couldn’t serve on both; and still allowed himself to be sworn in on both which speaks to his integrity; or didn’t know which speaks to his ignorance and/or hunger for power. Either way he knew that the minute he was sworn in for the Chabot Las Positas Board seat he would have to give up his HUSD Board seat. So instead of doing the honorable thing, he used the fact that HUSD Board had to act in accordance to the law to inflame his “supporters” to protest and cause further turmoil in the District.

    As far as Dr. Reynoso being the only Latino on the Board let’s all keep in mind that Proposition 16 went down to defeat a clear indication on the part of the electorate that race as a factor in admissions, hiring and perhaps by extension elections could not be a consideration. Dr. Reynoso came in third in the HUSD, not a close third by the way, a distant third, closer to fourth

    In a democracy the one with the most votes win. Dr. Reynoso did win, however in doing so had to give up that seat when he CHOSE to be sworn in to the Chabot Las Positas Board. Perhaps, for once his behind the scenes “puppeteer” machinations back fired. His supporters should keep that in mind when they call “foul,” “racist” and “white privilege.” You have been played by Dr. Reynoso. The HUSD Board actually showed restraint and deference by offering Dr. Reynoso a choice. Clearly they didn’t have to.

California’s constitution and government code both prohibit holding “incompatible offices” (i.e., if there are significant clash of duties or loyalties between the offices, or there are public policy considerations that make it improper). If you get elected to multiple offices that are incompatible, you are deemed to have forfeited the first office upon accepting the second. Has Dr. Reynoso, or any of the agencies involved, issued a legal opinion on whether the two offices are incompatible?


  20. This is not about racism. This is common sense and the law. It appears that Mr. Reynosa is rather power hungry.


  21. Looks like we have a case of the Independent Republic of Hayward School Board. The Board thinks it can make its own calls with impunity, along with its signature mix of arrogance and ignorance.

    It’s 2020, the year where public officials can have tantrums and complain to their mommies when their chosen candidate – in this case, Carlson- doesn’t win! Gasp! Obviously, Reynoso inspires the kind of voter confidence that these other board members will never be able to lay claim to.

    Guess what Hayward School Board? 2020 won’t last forever, and neither will you. But the Hayward community will still be there. And their voice takes precedence over your meltdowns.

  23. One more time, the Hayward School Board is like the College of Clowns. Reynoso won re-election to the board and should continue to serve. This is the essence of our Democracy. To call for his removal is the opposite of democracy. Those who call for the removal of Reynoso should be remembered by the electorate and opposed.


  24. If Robert Carlson had won both elections, it wouldn’t have been a problem. Oquenda will pay a large political price for her treachery.
